Terms of Service
Effective: October 4, 2026 · Version 2.1
This is a contract. Please read it carefully — especially Section 16, which requires individual arbitration and waives your right to a jury trial and class actions. You can opt out within 30 days of creating an account; see Section 16 for how.
1. Agreement
By creating an account or using StudentVision (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. Definitions
- "StudentVision", "we", "us": the team operating studentvision.app.
- "You", "your": the person using the Service or, if a minor, the parent/guardian accepting on their behalf.
- "Content": anything you create, upload, or send through the Service — notes, tasks, grades, messages, etc.
- "Pro": any paid subscription tier (Pro, Pro+ Family, future tiers).
3. Eligibility & accounts
You give your date of birth when you sign up. Students under 13 may use StudentVision only with a parent or guardian's permission; until a parent approves, an under-13 account is paused and is deleted after 30 days. If you are between 13 and 17, you confirm a parent or guardian has agreed to these Terms on your behalf, and some VisionChat features are limited for your safety (see the Privacy Policy). You are responsible for the activity that happens under your account and for keeping your password safe. Don't share accounts. Don't impersonate others. Tell us immediately if you suspect unauthorized access.
4. Acceptable use
When using StudentVision, you agree NOT to:
- Harass, threaten, dox, stalk, or hate-speech other users.
- Post sexual content involving minors — this is an immediate, permanent ban and reported to authorities.
- Spam, scrape, or attempt to extract bulk data from the Service.
- Reverse-engineer, attack, or attempt to bypass rate limits, RLS, or security controls.
- Use the Service to commit fraud, sell illegal goods, or violate applicable law.
- Submit AI-generated work to a class that prohibits it (see Section 7).
- Share anyone's phone number, home address, or other personal information in VisionChat; it's blocked automatically in chats and posts involving students under 18.
- Resell, rent, or sublicense the Service without our written permission.
We may suspend or terminate accounts that violate these rules. For severe violations (e.g. threats of violence, CSAM), we report to law enforcement.
5. Your content & license
You own your Content. By using the Service, you grant us a limited, worldwide, royalty-free license to host, store, transmit, display, and process your Content solely so the Service can function for you — for example, syncing your notes between devices or running them through StudyAI when you ask. This license ends when you delete the Content or your account, except for backups we retain for the period described in our Privacy Policy.
You represent that you have the rights to any Content you upload, and that it doesn't infringe anyone else's rights.
6. AI features (StudyAI)
StudyAI uses third-party large language models. AI output ("Output"):
- May be wrong, biased, or out of date — always verify important facts.
- Is provided to you under the same license terms as your Content. We don't claim ownership of Output you generate.
- Is not professional advice (medical, legal, mental health, financial).
- Is subject to provider acceptable-use rules (e.g. no extremist content, no malware, no privacy violations).
We don't train AI models on your data. How our AI provider may use StudyAI prompts is explained in the Privacy Policy (section 5). StudyAI is not a counselor or emergency service: if you're in crisis, call or text 988 in the US, or your local emergency number.
7. Academic integrity
StudentVision is a study companion, not a cheating tool. You are responsible for following your school's policy on AI assistance. Using StudyAI to write work you submit as your own — when your school forbids that — violates these Terms and may violate your school's honor code. We will cooperate with reasonable institutional investigations consistent with applicable privacy law.
8. Our intellectual property
The Service — including the StudentVision name, logo, UI, code, designs, and content we publish — is owned by us and protected by IP law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own academic purposes, subject to these Terms.
9. Subscriptions, billing & refunds
Free plan: free forever, subject to fair-use limits we publish in-app (e.g. daily StudyAI message cap).
Pro plans: billed monthly or annually in advance via Stripe, our payment processor. Annual plans bill once per year; monthly plans renew each month. Prices are shown in USD.
Cancellation: you can cancel anytime in one click from Profile → Billing. After cancellation you keep Pro until the end of your current billing period; we do not pro-rate monthly plans. Annual plans cancelled within 14 days of first purchase are refunded in full; after 14 days we issue a pro-rated refund for the unused months on request.
Price changes: we may change Pro pricing with at least 30 days' notice. The new price applies at your next renewal — you can cancel before then if you don't agree.
Failed payments: Stripe will retry. If a payment cannot be collected after retries, Pro features pause and your account drops to Free until you update billing.
10. Trials, promo codes & student discounts
Free trials, if offered, automatically convert to a paid subscription at the end of the trial unless you cancel. Promo codes are non-transferable, may have expiry dates, and cannot be combined unless we say so. If we offer a student discount, it will require a verified .edu email and may be revoked if the email is no longer active.
11. Third-party services
StudentVision integrates with services like Canvas (LMS), Stripe (payments), and AI model providers. Your use of those services is governed by their own terms. We're not responsible for outages, bugs, or data handling by third parties beyond what we contractually require of them.
12. Suspension & termination
You can delete your account at any time from Profile. We may suspend or terminate accounts that materially violate these Terms or pose a security/legal risk. Where possible, we'll give you notice and a chance to export your data first. If we terminate for cause, no refund is due.
13. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, or that AI output will be correct.
14. Limitation of liability
To the maximum extent permitted by law, StudentVision and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost grades, missed deadlines, lost data, or lost profits — arising out of your use of the Service. Our total aggregate liability for any claim is limited to the greater of (a) USD $100 or (b) the amount you paid us in the 12 months before the claim.
Some jurisdictions do not allow these limits — in that case, the limits apply to the maximum extent permitted.
15. Indemnity
You agree to indemnify and hold StudentVision harmless from claims arising out of (a) your Content, (b) your violation of these Terms, or (c) your violation of applicable law or third-party rights, except to the extent caused by our negligence or willful misconduct.
16. Disputes, arbitration & class waiver
We'd much rather work things out informally. Email legal@studentvision.app and we'll try to resolve any dispute within 60 days.
If we can't, any dispute will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in English, in the county where you live. You and we both waive the right to a jury trial and the right to bring or participate in a class action.
Opt-out: you can opt out of arbitration within 30 days of creating your account by emailing legal@studentvision.app with the subject "Arbitration Opt-Out" and your account email. Small-claims court is always available regardless.
17. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflicts-of-law principles. Mandatory consumer protections in your country of residence still apply.
18. Changes to these Terms
We may update these Terms. For material changes, we'll notify you in-app and by email at least 14 days before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
